Judge dismisses Trainor Glass termination suit

The bankruptcy judge hearing the employee class action suit against Trainor Glass Co. dismissed the case June 12, according to court documents. The suit, filed by former Trainor employee Katherine McNeel on her own behalf and on behalf of others similarly situated, charged that the company violated the Worker Adjustment and Retraining Notification Act by failing to provide notice of the company's complete closure.

In its motion to dismiss, attorneys for Trainor Glass charge that the plaintiff's WARN Act claim is a pre-petition claim that should be addressed in the Claims Administration Process, not by way of an adversary proceeding, according to court documents.
