Union dismisses case against Trainor Glass Co.; other lawsuits still pending

On April 11, trustees of the Glaziers, Architectural Metal and Glass Workers Local Union No. 27 Welfare and Pension Funds voluntarily dismissed their lawsuit against Trainor Glass Co.Filed February 28, the trustees' lawsuit claimed Trainor owed the funds $2,931, according to court documents.

Trainor Glass, which filed for Chapter 11 bankruptcyMarch 13, still faces litigation from trustees of the Indiana State Council of Roofers Health and Welfare Fund. The trustees' suit claims that beginning in November 2011, Trainor failed to make fund contributions, including payments for pension and health and welfare funds, per their collective bargaining agreement.

The company has also been named in a class action lawsuit, filed byKatherine McNeel, a former employee of Trainor Glass.The suit, filed on behalf of McNeel and all other similarly situated former Trainor employees, calls for recovery of damages in the amount of 60 days' pay and Employee Retirement Income Security Act benefits, according to court documents.

Trainor Glass Co. has been ordered to file a plan and disclosure statement for its Chapter 11 bankrupcty case by July 9, 2012.
